August=20 has been a busy month. Our Governmental Affairs Committee met = jointly with=20 the Real Property Section of the Florida Bar to draft legislation = intended=20 to limit the effects of rebating on large Commercial transactions. =

The=20 process was quite interesting. In general, both groups are = like-minded and=20 face similar circumstances and concerns in the market. Since = rebating=20 hasn=92t significantly affected residential property and has = virtually=20 eliminated the Agent=92s portion of premium, consensus was a = challenge.

The=20 outcome was a draft that is intended to prohibit rebating under = the first=20 $1,00,000 of liability and limited rebating thereafter to no more = than 30%=20 of the Agent=92s portion. The language continues to be tweaked = while we look=20 for a sponsor. John LaJoie, Skipper Henderson and Barbara Burke = took the=20 lead on the drafting committee. If you haven=92t seen a copy of = the latest=20 draft, please give Lee a call.

Lee and=20 Jenni are busy preparing for the upcoming convention at Hutchinson = Island=20 Marriott Beach Resort & Marina. Our theme this year is = =93Focus on=20 Quality=94. The convention format has been slightly changed to = place more=20 emphasis on Committee and Section work with the important = legislative=20 session fast approaching. As part of the Convention we need to = focus on=20 the Quality of our Association and membership. Lee is especially = happy to=20 include an offshore fishing contest in addition to the golf = tournament.=20 Hutchinson Island Marriott Beach Resort & Marina is a = beautiful place=20 and a wonderful facility. Mortgage = Impairment=20 Insurance

 

It seems that the = popularity=20 of the Internet=92s use in finding mortgage money has sparked = renewed=20 interest in the companies that want to sell mortgage impairment = insurance=20 as a substitute for lenders title insurance coverage. Recently the = FLTA=20 hosted representatives from several of the major title insurance = companies=20 doing business in Florida, Phil Schulman, representing the ALTA = and Wally=20 Senter, Title Insurance Coordinator for the Florida Department of=20 Insurance. The topic of the meeting was continued marketing of = this=20 product in Florida, even though it is prohibited by law. A recent = article=20 in the St. Pete times talked about how cheap and fast this product = was but=20 failed to mention that it is not available in Florida and that it = is=20 =93casualty insurance=94. The very description of the product said = no search=20 of the public records was needed because the losses would be paid = from the=20 pool of policy holders. That my friend is casualty insurance, and = is=20 expressed prohibited by Florida insurance law.

Mr. Senter was rock = solid on=20 his opinion that this type of coverage could not be legally = offered in=20 Florida and has conveyed that opinion to the offending companies. = It is=20 the intention of the Florida Land Title Association, with the aide = of the=20 Department of Insurance to make lenders aware of the prohibited = status of=20 mortgage impairment insurance.

 

 

 

New Trial = Membership=20 Offered

 

At the Winter = Board of=20 Directors meeting a new =93trial basis=94 membership has been = authorized. This=20 membership will allow first time members to try out membership in = our=20 association for a period of one year for the reduced rate of = $150.00.=20 During this trial period the firm will receive mailings and = information=20 and may attend seminars and the convention just as if they were a = regular=20 member. They will not have voting rights during the trial = membership. This=20 will allow someone who is new to the industry or has never taken = an=20 interest in the FLTA to sample our association for a limited=20 time.

 

2001 Convention = to be held=20 at the Hutchinson Island Marriott Beach Resort & = Marina

 

The 2001 Convention will be held = November=20 8th and 9th at the beautiful Hutchinson = Island=20 Marriott Beach Resort & Marina, formerly known as Indian River = Plantation. In listening to our members concerns about time out of = the=20 office the meeting time has been shortened to two days. The rates = are=20 reasonable, the location is first class and the time out of the = office has=20 been minimized. There is an executive, par 61, golf course on = premise that=20 will be used for our annual tournament and a fishing tournament = will be=20 offered as an alternative. If you haven=92t attended and FLTA = convention=20 lately, or at all, do yourself a favor and give it a try. You will = meet=20 people and learn things that you will not learn cooped up in your=20 office.

Incentives to=20 Membership

 

The FLTA = will=20 continue to offer one voucher for convention attendance and two = seminar=20 vouchers for all new members to our association (excluding the = trial=20 membership described above).
