you may think of it as a boring month, in Tallahassee, it is =
nothing of=20
the sort.=CA It means =
cold winter=20
weather, the legislators are in town buzzing like bees, and it=E2s =
the month=20
of our FLTA Winter Meeting, which by no means was cold or=20
dull.
Our winter =
meeting had good=20
participation from all around the state, consisting of a few =
special=20
guests, agents and underwriters, many of whom serve on the various =
committees and the board.=CA =
The=20
winter meeting, for those of you who have never attended, is a =
great=20
occasion to interact with other members, to learn about current =
and/or=20
forthcoming issues, and to make your voice =
heard.
At this year=E2s =
meeting we=20
worked on and resolved many topics, discussed areas of concern and =
interest and continued to work for the future of our =
industry.=CA The various committees were =
all hard at=20
work on their respective issues.=CA=20
As an example, the Governmental Affairs Committee focused =
on=20
legislative matters such as our Title Insurance Bill (HB1245,SB =
2382), the=20
Producer Model Licensing Act (SB 318), the Sales Tax Legislation, =
the=20
formation of a Legislative Study Commission regarding privacy =
issues of=20
the Public Records (SB 688/HB 1679), etc. etc. All of which will =
or could=20
have impact on our industry.=CA=CA A=20
highlight of the winter meeting was the attendance of two new =
faces, those=20
being Richard Allen Miller and George Moraitis, who serve as =
committee=20
members of the Real Property and Probate Section of the Florida =
Bar.=CA They were asked to join our =
Governmental Affairs Committee as non-voting members, as we will =
in turn=20
have two of our own FLTA members, John Haviland and Skipper =
Henderson=20
joining the Real Property & Probate Section committee as =
non-voting=20
representative members.=CA =
This=20
exchange will be beneficial to our industry, as it allows for =
better=20
cooperation, communication, and understanding of key=20
issues.
Another =
important guest=20
attending the winter meeting was Mr. Wally Senter of the =
Department of=20
Insurance.=CA Mr. Senter =
continues to=20
work with our industry and keep us apprised of forthcoming =
Department of=20
Insurance matters.=CA Mr. =
Center=20
updated us on the Mortgage Impairment issue which thankfully is =
quiet for=20
now.=CA He also indicated =
that not=20
too far in the distant future we may be faced with more Department =
of=20
Insurance rule making.=CA =
The rule=20
making would be setting up the renewal of the data call and other=20
matters.=CA This alone =
should wake a=20
few of you up, and when you do, my word to you is=20
=E3PARTICIPATE!=E4
In a final note, =
our=20
association will be making several improvements towards better=20
communication.=CA =
Improved=20
communication will allow for timely and expedient relay of =
important=20
information and breaking news as well as some cost savings.=CA To better serve you, it is =
crucial that=20
we have your current e-mail address as soon as possible.=CA Please make sure to check =
your listing=20
and contact the association office with any changes.=CA To mention just one item, =
we will be=20
=E3modernizing our website,=E4 which, among other things, will =
have a listing=20
of each committee with their respective committee chair and =
members.=CA This will allow all our =
members to be=20
=E3in the know=E4 of those working on specific =
areas.
Winter=20
Meeting Notes

Our winter =
meeting was the=20
scene of much activity. The Governmental Affairs and Judiciary =
Committee=20
considered the final wording of the proposed title insurance anti =
rebate=20
legislation and a few changes were instituted to make the bill=E2s =
intention=20
crystal clear. The bill has not yet been heard in committee so, at =
this=20
time it is hard to tell what its eventual fate will be. Other =
items to be=20
considered were the careful monitoring of any attempt to make =
mortgage=20
impairment insurance permissible with a legislative change. Having =
failed=20
to gain approval from the Department of Insurance in the =
administrative=20
arena it is conceivable that an attempt to change the law =
governing title=20
insurance could be attempted. The Committee also considered =
different ways=20
to make our legislators aware of the negative impact on real =
property=20
ownership new taxes would have. It was pointed out that real =
estate=20
ownership and transfer of ownership already bears a high level of =
taxation=20
in ad valorem and documentary stamps and class C intangible taxes. =
To=20
further tax the settlement process would unduly burden property =
owners.=20
With the opposition to the tax proposal already being made by the =
House=20
and the Governor this issue may resolve itself before the FLTA =
need weigh=20
in.

Insurance Coordinator for the Department of Insurance was present =
and=20
participated in the meeting.
This committee =
welcomed two=20
non-voting delegates from the Florida Bar Real Property , Probate =
and=20
Trust Law Section=E2s Title Insurance Committee. The delegates are =
George R.=20
Moraitis of Fort Lauderdale and Richard A. Miller from Lakeland. =
Both of=20
these gentlemen are attorney agents and active in the Real =
Property=20
Section. They both remarked on how similar the attitudes and =
concerns of=20
the attorney agent and the independent corporate agent=20
are.
=CA=CA=CA=CA=CA=CA=CA=CA=CA=CA=CA =
The issue of eliminating the=20
necessity of two witnesses on deeds as a proposal for next year =
was=20
discussed. Whether or not this elimination was to be tied to an =
increase=20
in a notary bond was discussed at some =
length.

Committee met with=20
Wally Senter to discuss a proposal for expediting forms submission =
and=20
approval by the Department.=CA =

The Forms =
Committee=20
met in Tallahassee during the February mid-winter meeting with =
Wally=20
Senter from the Department of Insurance in attendance.=CA We addresses the eight new =
endorsements=20
that have been developed for consideration by the FLTA governing=20
board.=CA All were =
recommended by the=20
committee with the exception of the Street Address =
Endorsement.=CA Ken Jannen suggested that =
it be=20
re-drafted along the lines of the CLTA 116 endorsement to avoid =
claims=20
created by language similar to the committee version that had =
cropped up=20
in California and which led to development of the CLTA 116.=CA The changes will be made =
and voted on=20
and the endorsement will be recommended to the FLTA board along =
with the=20
Access, Additional Insured (=E3Trustee=E4), Location, Change of=20
Partners-Shareholders-Beneficiaries (an expanded version of the =
Fairways=20
or Change of Partners Endorsement), and Last Dollar endorsements =
developed=20
by the committee as well as two new Leasehold Endorsements =
approved by the=20
ALTA for use with regular owners policies after the former ALTA =
Leasehold=20
policies were de-certified by that national =
body.
Mr. Senter =
said he=20
would review the leasehold endorsements to see whether they =
changed or=20
added coverages not previously approved by the Department in the =
Leasehold=20
policy jackets.=CA If =
not, they could=20
be approved without further rule making by the Department.=CA The other endorsements =
would require=20
formal rule making in any event which Mr. Senter said would not =
take place=20
before the second half of this year at the =
earliest.
We also =
discussed and=20
approved a proposed modification to the existing rules to permit=20
endorsements forms to be approved much more easily without the =
requirement=20
of a hearing or workshop.=CA =
However,=20
Mr. Senter felt the rule change would not be approved by the =
Department=20
since he felt a workshop was a requirement of statute in all =
cases.=CA The task of researching the =
statutes=20
alluded to by Mr. Senter was given to Floyd Krause and his report =
is=20
forthcoming.=CA We hope =
to challenge=20
the Department to investigate further the possibility of giving =
the title=20
insurance industry greater flexibility and speed when it comes to =
keeping=20
pace with other states in adopting new forms of coverage demanded =
by our=20
customers.
After the =
meeting,=20
Mr. Senter suggested that the Administrative Rule requiring =
premium=20
charges for =E3additional lands=E4 added to revolving credit =
construction=20
loans needs to be re-written in order to satisfy his desire that =
it=20
clearly requires that the value of future improvements be included =
in the=20
premium calculations.=CA =
While many=20
in attendance pointed out the difficulty and impracticality of =
adding this=20
new wrinkle in the rule, a subcommittee has been formed to look =
into=20
re-drafting the statute to make it less ambiguous and acceptable =
to the=20
Department, if possible, without creating undue accounting and=20
documentation problems.=CA =
The=20
subcommittee consists of Pat Hancock from Fidelity National Title; =
Pat=20
Jones from the Fund; Larry Plank from LandAmerica Title; Mike =
Davis from=20
Old Republic Title; and the chairman, Alan McCall from First =
American=20
Title.

committee made an appeal to the Department of Veteran=E2s =
Affairs=E2 St.=20
Petersburg Loan Guaranty Office for a clarification regarding =
VA=E2s=20
=E3Allowable Closing Cost=E4 list.=CA=20
This appeal was made due to the VA Pamphlet 26-7 Revised =
(a/k/a VA=20
Lender=E2s Handbook) prohibition of a =E3closing=E4 or =
=E3settlement=E4 fee to a=20
veteran borrower.=CA We =
bought to=20
VA=E2s attention the provisions of Rule-4-186.003, F.A.C. =
requiring all=20
Florida title agents to charge such a fee and to isolate it on the =
closing=20
statement.=CA The folks =
at VA were=20
eager to assist us.=CA =
Unfortunately,=20
the only possible resolution would be to advise lenders making=20
VA-guaranteed loans in Florida, that they are to reduce their =
=E3origination=20
fee=E4 (limited by law to 1% of the loan amount) by the amount of =
any=20
closing fee charged to the borrower.=CA=20
The committee didn=E2t think this would be palatable to the =
lending=20
industry and the =E3the medicine would be worse than the =
disease.=E4 So, in=20
purchase transactions, sellers will no doubt continue to be =
assessed=20
closing fees.=CA On =
refinances, title=20
agents remain at peril that the lender will not fund the loan with =
such a=20
charge reflected.

University of Alabama Law School. He served in the US Air Force =

Company John was a long term active member of the Florida Land =

Association. John was a recipient of the Raymond O. Denham =
Memorial Award=20
for leadership in the title insurance industry and a long term =

the Government Affairs and Judiciary Committee. John was an active =

of the American Bar Association and the Florida Bar =

Brenda Biddle =
DeWitt passed=20
away on February 1st, 2002 in Fort Pierce. Brenda was a =

of Orlando but had resided in Fort Pierce for the past 33 years. =

served as Vice President and Manager of Treasure Coast Abstract =
&=20
Title Co., of Fort Pierce where she had been employed for over 25 =
years.=20
Brenda was a very well respected title professional in her =
community and=20
her services were attended by some 300 friends and family. Brenda =

survived by her husband Danny =E3Dexter=E4 DeWitt, son Robert =
DeWitt and=20
daughter Dee Dee DeWitt all of Fort Pierce. Brenda was a member of =

Florida Land Title Association, The St. Lucie County Chamber of =
